Time & Duration

A timer will be set to begin at the precise time the client booked their shoot; even if the client isn’t present, arrives late, or is not fully prepared. That timer will keep track of the duration of the shoot and will notify the client of its conclusion. If the client goes over the allotted amount of time provided with their package or wants their package time extended; ElevatedbyCJ will automatically charge an additional $150/ every hour after. If the client is late to the shoot they are required to pay an $50 late fee. The arrival time of ElevatedbyCJ, start of shoot, end of shoot & departure time will all be recorded for clients & ElevatedbyCJ’s reference. If the client request to shoot after 12am anyday of the week, the rate of event Photography/videography increases by $100/hr on top of the normal rate stated in the event package. 

Photo Specifics

All Raw/Unedited Files will be uploaded within the specified time listed in the package after the shoot has concluded. Only SELECT quality media deemed “usable” (i.e. Clear, In-Focus, Sharp & Free of Error) by ElevatedbyCJ will be delivered electronically via a Private Online Link and or additional form of transfer that the client wants, provided by ElevatedbyCJ, within the specified turn-around time listed in your package. This link will conclude after 30 days & can be shared with anyone during that time. The client can save all photos/videos from the link provided. ElevatedbyCJ is not responsible if the client does not save the images/videos via the link provided after the conclusion of the album expires. ElevatedbyCJ is not responsible for keeping or saving the images or content from the shoot longer than the 30 days provided.

Rights to Photographs

ElevatedbyCJ retains all the rights to use, share, edit, repost, transform, or alter all photos/video taken during the session. ElevatedbyCJ also has the right to use said photos/videos for any promotional purposes at any point in the future. 

Retouched & EDited Images

After ElevatedbyCJ has uploaded or sent the client their images to view via the online link, the client can look over and select the files they want to be “retouched”. The number/amount of retouches that you can select is provided in the package details when you booked. Retouches involve enhancing, removing blemishes, smoothing or softening skin and Color graded edits involve color augmentation, exposure, light adjustments, cropping and readjusting images for better clarity and quality. 

Safety

If ElevatedbyCJ at any point during the photoshoot is threatened, hurt, injured or safety is jeopardized because of the client and or due to any of the clients personal associates/guests present at the shoot; ElevatedbyCJ can leave immediately & revoke access to any and all media taken. No refund or percentage of compensation sent will be granted back to the client. 

Company Property

In the unlikely and rare event that digital files have been lost, stolen, or destroyed for reasons beyond the company’s control, including but not limited to camera, hard drive, or equipment malfunction, ElevatedbyCj’s liability is limited to rescheduling the shoot entirely or the return of all payments received for the shoot. The limit of liability for a partial loss of originals shall be a prorated amount of the exposures lost based on the percentage of total number of originals. ElevatedbyCJ is not liable for the loss of images beyond the lesser of the final delivery of all products included in the package or one year. 

Personal & Property Damage

“ElevatedbyCJ” is not responsible for any damage to any personal property of the clients while in the session. ElevatedbyCJ is also not responsible for any personal injuries or accidents that occur during the session. 

Turn-Around Time

All Paid photo and video sessions taken are subject to an allotted turnaround time highlighted in the package of the clients choosing. Client can opt-in for RUSH edits at a pro-rated amount when booking, but if not selected, all media will be sent out within or at the maximum amount of time detailed in your package. Paid shoots take priority over collaboration shoots, so turn-around times for Collaboration shoots may very and are solely dependent on completion of all paid shoots taken before. ElevatedbyCJ if contacted can tell you his current TA time frame for all collaborative shoots. ElevatedbyCJ will reach out to the client if the content is not delivered within the specified TA time and a new TA will be given as well as a reason as to why additional time is needed for your images/videos. 

Sole Ownership

All and any edits, color grades, versions of photos or media rendered are only applicable to the client who booked the shoot; any other guests or additional parties, involved or captured, in the shoot will not be able to receive any edits, without paying for them separately. Prices can be provided by ElevatedbyCJ if any additional parties want edited or RAW images taken. 

Early Termination

Once a shoot has started and if the shoot is then rendered incomplete/finished due to unforeseen circumstances such as a personal matter or the client wants to end the shoot early for any particular reason. The full remaining balance of the shoot will still need to be paid before any media captured is sent to the client. The Client however, is entitled to all of the select photos/videos deemed “useable” by ElevatedbyCJ, up to the conclusion of the shoot. 

Trademark

If the client decides to repost, share, forward or distribute the “edited/retouched” images on any social media platform or through any medium; Elevatedbycj requests the company be tagged, “@“ or given credit for any photos or videos published. 

Image/Video Duration:

Every Client will receive their images/video after the shoot has concluded. They will be uploaded via either Apple iCloud or Google Photos. You as the client will have access to your album for up to 7 days. During that time, you will have the ability to download, share or save any photos and videos in the album, but after the 7 day period has concluded the album will expire & images/videos purged. The images/video cannot be brought back or resent after the album has been deleted. ElevatedbyCJ cannot be held responsible in any shape or form if the client did not save, download or share any of the images included in their private album within the 7 day period nor will he refund any amount of money paid if the client failed to save or download the content made available for 7 days. You can request the images be copied and saved as a backup with ElevatedbyCJ or extend your album duration to 3 months for $125 USD.

Refunds

If the client does not like or deem the photos/video footage unacceptable, they will have to communicate their discrepancies with ElevatedbyCJ within 24 hours of final media being sent to them. If the client does not communicate any issues with the photos/video footage, ElevatedbyCJ is not responsible for any additional editing, retouching, shooting or saving of images after 24 hours of "initial" receipt of final media. In the case that the client requests a refund within 24hrs & a resolution cannot be agreed upon, the maximum amount awarded will not exceed the total cost of the shoot nor can the client request, demand or ask for additional money. The refund will additionally only be %50 of the total amount paid. The deposit and any travel fees associated with the shoot, will not be refunded.
